The Delhi Minorities Commission

NOTIICATION

No.F.10/3/98/Home(P)Estt./Part-1(Rules)/-In exercise of the powers conferred by sub-section(1) of section 16 of the Delhi minorities Commission Act. 1999 (Delhi Act No.1 of 2000). The Government of National Capital Territory of Delhi hereby makes the following rules, namely :-

Chapter-I

1.Short title and commencement:

(1)These rules may be called the Delhi Minorities Commission Rules 2000. (2) They Shall come into force on the date of their publication on the official gazette.

2 Definations: in these rules, unless the context otherwise requires:

  1. ‘Act’ means the Delhi minorities Commission Act, 1999 (Delhi Act No.1 of 2000).
  2. ‘Chairperson’ means the chairperson of the Delhi Minorities Commission appointed under sub section (2) of section 3 of the Act.
  3. ‘Commission’ means the Delhi Minorities Commission constituted under section 3of the Act.
  4. ;Government’ means the Lieutenant Governor reffered to in article 239AA of the Constitution:
  5. ‘Member’ means a member of the Commission.

 

Chapter-II

SALARY AND OTHER CONDITIONS OF SERVICE OF THE CHAIRPERSON AND MEMBERS OF THE COMMISSION

3.Salary of Chairperson and Members of the Commission:

  1. There shall be paid to the Chairperson of the Commission, a fixed consolidated amount of Rs.18000/- (Rupees

Eighteen Thousand only) per mensem if he/she renders full time service.

  1. There shall be paid to each Member of the Commission a fixed consolidated amount of Rs. 14,000(Rupees Fourteen Thousand only) per mensem if he/she renders full time service.
  2. If the Chairperson or Members of the Commission render part time service to the Commission they shall be paid monthly amount at the rates of Rs.10000/- (Rupees Ten Thousand) only and Rs.7,500/- (Rupees Seven Thousand Five Hundred only) as honorarium respectively.
  3. The Chairperson of the Commission shall have the status of Head of Department and will enjoy the same facilities being accorded as per rules and regulations as are for the time being applicable to the officers of Delhi Government in corresponding capacity.
  4. The conditions of service relating to travelling allowances and conveyance facilities to which the Chairperson and Members of the Commission will be entitled shall be such as are, for the time being, applicable to an IAS officer of Super-time scale:

Provided that if a person who, immediately before the date of assuming office of the Chairperson or Member of the Commission, was in receipt of, or being eligible to received, had elected to draw pension (other than a disability or wound pension) in respect of any previous service under the Government of the Union or under the Government of a State, his/her total emoluments in respect of services as the Chairperson or as Member of the Commission, as the case may be, shall not exceed the amount drawn last as pay, that is to say, the consolidated fee plus pension drawn by him/her shall not exceed the last pay drawn.

4.Grant of leave to Chairperson and members of the Commission:

  1. A full time Chairperson and Member shall be entitled to leave as follows:

a) earned leave, half pay leave and commuted lave in accordance with the Central civil Services (Leave) Rules , 1972 as amended from time to time; and b) extraordinary leave as admissible to the temporary Government servants under the Centrals Civil Services(Leave) Rules, 1972 as amended from time to time.

2. The Chairperson shall be authority to sanction leave to Members, and the Government shall be the authority competent to sanction leave to the Chairperson.

5.Salary and allowances of the Secretary of the Commission:

  1. Salary and allowances, leave, provident fund, age of superannuating , pension and retirement benefits, medical facilities and other conditions of service of secretary of the Commission shall be regulated in accordance with such rules and regulations as are for the time being applicable to an officer of the Government in his respective cadre.
  2. Staff of the Commission:
  3. The staff sanctioned for the Delhi Minorities (Provisional) Commission shall be deemed to have been sanctioned for the Delhi Minorities Commission and shall draw their salary and allowances according to posts/ranks as being drawn by the employees of the Government.
  4. The Number of posts and the scales of pay of various categories of posts in the Commission shall be such as may be sanctioned by the Government from time to time.
  5. The posts in the staff of the Commission shall be filled up from the respective cadres of the Government wherever they exist, other posts shall be filled as per the existing recruitment rules in respect of posts of same nomenclature in the Government.
  6. The condition of services of the officers and other employees of the Commission in matter relating to pay, allowances, leave, provident fund, age of superannuation, pension and retirement benefits, medical facilities and other conditions of service shall be regulated in accordance with such rules as applicable to officers/officials of the respective cadres in the Government belonging to Group ‘A’, ‘B’ and ‘C’ services. For other posts, the service conditions shall be similar to posts of same nomenclature in the Government.

6. Accounts and Audit:-

  1. The annual statement of accounts of the Commission for every financial year shall be prepared in Form ‘A’ as may be modified from time to time with the approval of the Government, by the Secretary or such officer of the Commission as may be authorized by the Secretary in this behalf.
  2. The annual statement of accounts duly approved by the Commission shall be submitted by the Secretary to the Government by such date as may be specified by the Government.
  3. The Commission shall forward to the Government quarterly reviews of the progress of the expenditure incurred and the expenditure likely to be incurred during the remaining part of the financial year or as and when called by the Government.
  4. The Commission shall furnish annually the utilization certificate certifying that the budget/grant has been utilized as per terms and conditions.
  5. The Secretary shall supervise the maintenance of the accounts of the Commission and the compilation of the financial statements and returns and shall ensure that all accounts, books, connected vouchers and other documents and papers of the Commission required by the audit officer for the purpose of auditing the accounts of the Commission are placed at the disposal of that officer.
  6. The annual statement of accounts referred to in sub section (1) of section 12 of the Act shall be signed and authenticated by the Secretary.
  7. The annual statement of accounts shall be submitted to the audit officer appointed by the Comptroller and Auditor General of India as per sub-section (3) of section 12 of the Act.

(8) On receipt of the audit report, the Commission shall, within three months, remove any defect or irregularity pointed out therein and report to the Government and to the audit officer about the action taken by it thereon.
